{"id":5238,"date":"2014-04-10T04:13:59","date_gmt":"2014-04-10T03:13:59","guid":{"rendered":"http:\/\/soerenkern.com\/?p=5238"},"modified":"2014-09-08T22:59:21","modified_gmt":"2014-09-08T21:59:21","slug":"european-dual-use-exports-iran-continue-apace","status":"publish","type":"post","link":"https:\/\/soerenkern.com\/web\/2014\/04\/10\/european-dual-use-exports-iran-continue-apace\/","title":{"rendered":"European Dual-Use Exports to Iran Continue Apace"},"content":{"rendered":"<p><a href=\"https:\/\/soerenkern.com\/web\/wp-content\/uploads\/2014\/05\/leifeld-machine-tool.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter size-full wp-image-5239\" src=\"https:\/\/soerenkern.com\/web\/wp-content\/uploads\/2014\/05\/leifeld-machine-tool.jpg\" alt=\"leifeld machine tool\" width=\"640\" height=\"480\" srcset=\"https:\/\/soerenkern.com\/web\/wp-content\/uploads\/2014\/05\/leifeld-machine-tool.jpg 640w, https:\/\/soerenkern.com\/web\/wp-content\/uploads\/2014\/05\/leifeld-machine-tool-300x225.jpg 300w\" sizes=\"auto, (max-width: 640px) 100vw, 640px\" \/><\/a><\/p>\n<p><em>More than a dozen EU countries have supplied Iran with dual-use technologies in one form or another in recent years, and much of that trade was lawful and in compliance with export control regulations, research shows.<\/em><!--more--><\/p>\n<h3><strong>European Dual-Use Exports to Iran Continue Apace<\/strong><\/h3>\n<p>Soeren Kern | <a title=\"European Dual-Use Exports to Iran Continue Apace\" href=\"http:\/\/www.gatestoneinstitute.org\/4256\/iran-europe-nuclear-dual-use\" target=\"_blank\">Gatestone Institute<\/a> | April 10, 2014<\/p>\n<p>Spanish police have arrested four individuals suspected of attempting to export to Iran industrial machinery that could be used to make weapons of mass destruction.<\/p>\n<p>The machinery involves so-called <a href=\"http:\/\/en.wikipedia.org\/wiki\/Dual-use_technology\" target=\"_blank\">dual-use<\/a> equipment\u2014products and technologies that can be used for both civilian and military applications.<\/p>\n<p>Although the European Union <a href=\"http:\/\/eur-lex.europa.eu\/LexUriServ\/LexUriServ.do?uri=OJ:L:2009:134:0001:0269:en:PDF\" target=\"_blank\">bans the export<\/a> to Iran of certain dual-use machinery and technology that could be used to aid Iran\u2019s military program, loopholes abound and enforcement remains patchy.<\/p>\n<p>More than a dozen EU countries have supplied Iran with dual-use technologies in one form or another in recent years, and much of that trade was lawful and in compliance with export control regulations, research shows.<\/p>\n<p>But the illegal transfer of dual-use equipment to Iran continues unabated, due to lax enforcement and the failure of European governments to keep pace with the growing number and sophistication of actors involved in security-related trade with Tehran.<\/p>\n<p>Where there have been arrests, those cases are believed to represent only the tip of the iceberg of the illegal trade in dual-use items, analysts believe.<\/p>\n<p>In Spain, the four suspects\u2014an Iranian and three Spaniards\u2014were arrested on April 1 for secretly trying to export to Iran industrial equipment and technical blueprints that could be used for making missile parts or enriching uranium, according to a <a href=\"http:\/\/www.guardiacivil.es\/es\/prensa\/noticias\/4860.html\" target=\"_blank\">statement<\/a> released by Spain\u2019s Civil Guard on April 7.<\/p>\n<p>The Iranian, a 47-year-old male, was arrested in Palma de Mallorca on Spain\u2019s Balearic Islands and is being detained on preliminary charges of contraband in dual-use material, belonging to a criminal organization and money laundering.<\/p>\n<p>The three Spaniards\u2014all from the same family\u2014are a father, in his 70s, and a son, in his 40s, who were arrested in Tarragona, in eastern Spain, and a daughter, in her 40s, who was arrested in nearby Barcelona. All four face the same charges, which carry potential prison terms of about 10 years.<\/p>\n<p>The police investigation, also known as Operation Terracotta, began in 2013 when the Civil Guard discovered that two <a href=\"http:\/\/www.leifeld.co.uk\/\" target=\"_blank\">Leifeld<\/a> dual-use metal-forming machines had been illegally imported into Spain from Britain. According to the Civil Guard, the three Spanish suspects were administrators of the offending import firm who attempted to hide the true destination of the equipment by waiting for an optimal time to secretly forward the shipment to Iran.<\/p>\n<p>In addition to the two machines, police seized documentation about the sale and export of dual-use equipment, as well as a large amount of computer data that is still being analyzed, according to the Civil Guard. Police also confiscated the equivalent of 10,000 euros ($14,000) in euros and Iranian rials that were earned from contraband.<\/p>\n<p>This is not the first time that Spanish police have arrested individuals for illegally exporting dual-use materials to Iran.<\/p>\n<p>In January 2013, <a href=\"http:\/\/www.policia.es\/prensa\/20130111_2.html\" target=\"_blank\">police arrested<\/a> two individuals in the Basque Country and seized a truck carrying 44 nickel and chromium alloy valves that were intended to be used for Iran\u2019s nuclear program. A company\u2014Fluval Spain\u2014was also accused of using front companies in the United Arab Emirates for the triangulation of shipments and payments channeled through banks in third countries in order to disguise Iran as the final destination of the equipment, <a href=\"http:\/\/www.policia.es\/prensa\/20130111_2.html\" target=\"_blank\">according<\/a> to the Spanish Interior Ministry.<\/p>\n<p>Spain continues to be an active exporter of dual-use equipment to Iran (as well as to countries like China, Cuba and Venezuela). Despite <a href=\"http:\/\/eeas.europa.eu\/cfsp\/sanctions\/docs\/measures_en.pdf\" target=\"_blank\">enhanced EU sanctions<\/a> against Tehran over its nuclear program, Spanish dual-use exports to Iran reached 31 million euros in 2012, up from 17 million euros ($43 million) in 2011, according to <a href=\"http:\/\/www.revistasice.com\/CachePDF\/BICE_3043_3-32__78C84E10C09F105E780D43FD8F2A21CC.pdf\" target=\"_blank\">statistics<\/a> published by the Spanish Defense Ministry.<\/p>\n<p>Nor is Spain the only European country profiting from the legal and illegal dual-use trade with Iran.<\/p>\n<p>In July 2013, an <a href=\"http:\/\/www.reuters.com\/article\/2013\/07\/02\/us-iran-alumina-weapons-idUSBRE9610F520130702\" target=\"_blank\">expos\u00e9<\/a> published by the Reuters news agency reported that Iran was importing weapons grade alumina\u2014used for making missile components and centrifuges for enriching uranium\u2014from several European countries, including Belgium, France, Germany, Italy, Hungary and Slovenia.<\/p>\n<p>In May 2013, it <a href=\"http:\/\/www.reuters.com\/article\/2013\/05\/22\/iran-sanctions-un-idUSL2N0E32KA20130522\" target=\"_blank\">emerged<\/a> that Switzerland-based commodities giants Glencore Xstrata and Trafigura were engaged in alumina-for-aluminum swap deals with Iran that skirted international sanctions. In March 2013, Reuters <a href=\"http:\/\/uk.reuters.com\/article\/2013\/03\/01\/uk-iran-sanctions-glencore-idUKBRE92007G20130301\">reported<\/a> that Glencore had supplied thousands of tons of alumina to an Iranian firm linked to the country\u2019s nuclear program.<\/p>\n<p>In neighboring Germany, the multi-billion euro bilateral trade relationship with Iran continues unabated, despite ongoing questions over Tehran\u2019s nuclear program.<\/p>\n<p>In December 2013, the Tel Aviv-based newspaper <em>Haaretz<\/em> <a href=\"http:\/\/www.haaretz.com\/news\/middle-east\/.premium-1.562287\" target=\"_blank\">reported<\/a> that it had obtained a list from late 2012, showing the names of 136 German companies doing business with Iran. One company on the list, Bomafa Armaturen GmbH, is a maker of high-pressure valves and specialty valves for use in nuclear power stations. Another German company, Gemu GmbH &amp; Co. KG, is a leading manufacturer of valves, instrumentation and measurement systems.<\/p>\n<p>In July 2012, the <em>Jerusalem Post<\/em> <a href=\"http:\/\/www.jpost.com\/Iranian-Threat\/News\/German-firms-still-ship-dual-use-goods-to-Iran\" target=\"_blank\">reported<\/a> that it had obtained an uncensored list from late 2011, showing hundreds of German and Iranian enterprises in a flourishing trade relationship. According to the <em>Post<\/em>, one company on the list, the Baden-W\u00fcrttemberg-based engineering giant Herrenknecht AG, was suspected of delivering to Iran heavy tunneling equipment\u2014some of which has the capability of drilling down to depths of 6,000 meters (19,700 feet)\u2014that could be used to build more underground nuclear facilities.<\/p>\n<p>In February 2014, police in Bonn <a href=\"http:\/\/www.generalbundesanwalt.de\/de\/showpress.php?newsid=493\" target=\"_blank\">arrested<\/a> a German-Iranian man suspected of supplying Iran with components for use in its missile program. Federal prosecutors accused Dr. Ali Reza B, 62, of providing Iran with dual-use equipment worth nearly 230,000 euros ($315,000) in 12 deliveries from 2011 to 2013. The items were manufactured in Germany and prosecutors allege the suspect delivered the items through a front company in an unidentified neighboring Arab country to avoid embargo restrictions.<\/p>\n<p>In November 2013, a court in Hamburg found four men\u2014one German and three German-Iranians\u2014<a href=\"http:\/\/www.abendblatt.de\/politik\/deutschland\/article121709622\/Haftstrafen-fuer-Kaufleute-wegen-illegaler-Iran-Geschaefte.html\" target=\"_blank\">guilty of smuggling<\/a> 92 German-produced specialized valves for use in Iran\u2019s Arak plutonium reactor and arranging the shipment of 856 nuclear-usable valves from India to Iran in 2010 and 2011. The case is believed to be the largest known breach of dual-use restrictions on Iran.<\/p>\n<p>Other examples abound:<\/p>\n<blockquote><p>In <a href=\"http:\/\/www.parlement-wallon.be\/content\/default.php?p=04-03-02&amp;type=28&amp;id_doc=30248\" target=\"_blank\">Belgium<\/a>, the Energy Ministry launched an investigation into two companies over allegations they illegally provided Iran with zirconium powder, a mineral used in the reactors of nuclear power plants and which can also be used in making nuclear bombs.<\/p>\n<p>In <a href=\"http:\/\/www.iranwatch.org\/sites\/default\/files\/uk-judgment-pouladian-kari.022213pdf_0.pdf\" target=\"_blank\">Britain<\/a>, a British businessman attempted to export 361 dual-use electrical switchgears to Iran via a company in Dubai. In <a href=\"http:\/\/www.iranfocus.com\/en\/index.php?option=com_content&amp;view=article&amp;id=20492:iran-weapon-dealers-7m-assets-frozen&amp;catid=4:iran-general&amp;Itemid=26\" target=\"_blank\">Ireland<\/a>, a father-son company smuggled more than 100 million euros ($137 million) in U.S.-made military equipment to the armed forces of Iran. In the <a href=\"http:\/\/www.dutchnews.nl\/news\/archives\/2010\/04\/four_arrested_over_dual-use_ex.php\" target=\"_blank\">Netherlands<\/a>, four individuals were arrested for exporting dual-use goods to Iran without the necessary export permits.<\/p>\n<p>In <a href=\"http:\/\/www.hs.fi\/english\/article\/Attempts+made+to+acquire+Finnish+technology+for+building+weapons+of+mass+destruction\/1135256728816\" target=\"_blank\">Finland<\/a> and <a href=\"http:\/\/www.reuters.com\/article\/2011\/02\/28\/us-norway-iran-idUSTRE71R6J720110228\" target=\"_blank\">Norway<\/a>, Iran has been accused of trying to obtain advanced missile technology for possible use in delivering nuclear weapons. In <a href=\"http:\/\/www.thelocal.se\/20130206\/46034\" target=\"_blank\">Sweden<\/a>, an individual was found guilty of knowingly trying to export dual-use technology to Iran, where it could be used as part of nuclear arms production.<\/p><\/blockquote>\n<p>For every dual-use related arrest and prosecution, however, many more illegal transfers are believed to remain undetected. This is due to a mix of bureaucratic and legal snafus and lax enforcement, as well as to the failure of many European governments to adequately understand the deceptive methods used to conceal the illegal trade in security-related goods to Iran, according to a <a href=\"http:\/\/www.sipri.org\/research\/disarmament\/eu-consortium\/publications\/nonproliferation-paper-30\" target=\"_blank\">recent study<\/a> on penalties and prosecutions of dual-use offenses in Europe.<\/p>\n<p>A <a href=\"http:\/\/www.reuters.com\/article\/2013\/05\/22\/iran-sanctions-un-idUSL2N0E32KA20130522\" target=\"_blank\">confidential<\/a> U.N. Panel of Experts that was leaked to the media sums it up this way: \u201cIran continues to seek items for its prohibited activities from abroad by using multiple and increasingly complex procurement methods, including front companies, intermediaries, false documentation, and new routes.
