European Quran Burnings Fuel Calls for International Blasphemy Law<\/h3>\n

Denmark and Sweden, under growing pressure from Muslim countries, are contemplating free speech restrictions that would outlaw burning copies of the Quran. Recent Quran-burnings by anti-Islam activists in Copenhagen and Stockholm have sparked angry protests in several Muslim countries and increased the terrorist threat against the two Scandinavian countries.<\/p>\n

The threats have fueled a debate about balancing free speech and security, but some observers are\u00a0warning<\/a>\u00a0that changing free speech laws in the middle of a security crisis would be \u201cgiving in to blackmail.\u201d The editorial board of\u00a0Expressen<\/em>, one of Sweden\u2019s oldest newspapers,\u00a0noted<\/a>\u00a0that doing so \u201cwould in practice mean that foreign actors are given power over which opinions are allowed in Sweden.\u201d<\/p>\n

On July 31, the foreign ministers of the 57 member states of the Organization of Islamic Cooperation (OIC) \u2014 a Saudi Arabia-based group that has long\u00a0called<\/a>\u00a0for an international blasphemy law that would not only guarantee special protections for Islam, but also shield it from legitimate scrutiny and criticism \u2014\u00a0convened<\/a>\u00a0an \u201cextraordinary session\u201d to discuss responses to the Quran burnings.<\/p>\n

In a\u00a0statement<\/a>, the OIC expressed anger at Denmark and Sweden for failing to outlaw \u201cthe repetition of such acts of aggression\u201d that \u201cspread hatred and contempt for religions and threaten global peace, security and harmony.\u201d The OIC also called for an international law aimed at \u201ccriminalizing incitement to violence based on religion or belief,\u201d and demanded that the European Union \u201cclarify the gravity and consequences of persisting in insulting Islamic symbols and sanctities.\u201d<\/p>\n

On July 12, the United Nations Human Rights Council (HRC)\u00a0approved<\/a>\u00a0an OIC-sponsored resolution \u2014 \u201cCountering Religious Hatred Constituting Incitement to Discrimination, Hostility or Violence\u201d \u2014 that seeks to outlaw \u201cpublic and premeditated acts of desecration of the Holy Qur\u2019an.\u201d The resolution, which passed with a vote of 28 in favor, 12 against and 7 abstentions, was opposed by the United States and the European Union on free speech grounds.<\/p>\n

The OIC has long\u00a0pressed<\/a>\u00a0the European Union and the United States to impose limits on free speech and expression about Islam. It recently has redoubled efforts to persuade Western democracies to implement HRC Resolution 16\/18, which\u00a0calls<\/a>\u00a0on all countries to combat \u201cintolerance, negative stereotyping and stigmatization\u201d of \u201creligion and belief.\u201d<\/p>\n

Resolution 16\/18, which was\u00a0adopted<\/a>\u00a0at HRC headquarters in Geneva in March 2011, is widely\u00a0viewed<\/a>\u00a0as the cornerstone of OIC efforts to advance the international legal concept of \u201cdefaming Islam.\u201d International human rights law as currently constituted protects individuals, not religions. The OIC effectively is seeking a paradigm shift to the existing international legal order that would make criticizing Islam a violation of human rights \u2014 at the expense of free speech.<\/p>\n

Denmark and Sweden, known for their storied\u00a0traditions<\/a>\u00a0of constitutionally-protected free speech, have long been the target of\u00a0Islamists<\/span>. In September 2005, the Danish newspaper\u00a0Jyllands-Posten<\/em>\u00a0published 12 editorial cartoons, some of which depicted Mohammad, the prophet of Islam. This sparked deadly riots across the Muslim world. As the\u00a0Middle East Quarterly<\/em>\u00a0noted<\/a>\u00a0at the time, the cartoon controversy \u201chad less to do with genuine outrage over the depiction of Islam\u2019s prophet and more to do with the ambitions, first, of a small group of radical imams, and, later, of jousting Middle Eastern powers.\u201d<\/p>\n

In Sweden, a Quran-burning rally in Stockholm in January 2023\u00a0enraged<\/a>\u00a0the Turkish government and jeopardized Sweden\u2019s bid to join the North Atlantic Treaty Organization (NATO). Turkish President Recep Tayyip Erdo?an\u00a0warned<\/a>\u00a0that \u201cas long as you allow my holy book, the Quran, to be burned and torn, we will not say \u2018yes\u2019 to your entry into NATO.\u201d That threat was widely interpreted as a demand that Sweden enact a new blasphemy law as a condition for NATO membership.<\/p>\n

On February 8, in a reversal of long-standing policy, the Swedish government\u00a0refused<\/a>\u00a0to allow anti-Islam activists to burn a Quran in front of the Turkish embassy in Stockholm. They subsequently prohibited a Quran burning rally that was planned for February 20 in front of the Iraqi embassy in the Swedish capital. On June 12, the Swedish Court of Appeals\u00a0ruled<\/a>\u00a0that those bans were unconstitutional.<\/p>\n

Since then,\u00a0two Iraqi immigrants<\/a>\u00a0\u2014 37-year-old Salwan Momika, who arrived in Sweden from Iraq in 2018 and received a three-year residence permit in April 2021, and 48-year-old Salwan Najem, who migrated to Sweden from Iraq in 1998 and became a Swedish citizen in June 2005 \u2014 have repeatedly desecrated the Islamic holy book.<\/p>\n

On June 28, Momika\u00a0burned<\/a>\u00a0a Quran outside Stockholm\u2019s Central Mosque. On July 20, Momika and Najem\u00a0stomped<\/a>\u00a0on a Quran outside the Iraqi Embassy in Stockholm and on July 31, they\u00a0burned<\/a>\u00a0a Quran in front of the Swedish Parliament. The desecrations\u00a0provoked<\/a>\u00a0widespread anger across the Muslim world, including from Erdo?an, who\u00a0vowed<\/a>\u00a0to \u201cteach the arrogant Western people that it is not freedom of expression to insult the sacred values of Muslims.\u201d<\/p>\n

Some analysts say Erdo?an, whose longstanding\u00a0goal<\/a>\u00a0has been to criminalize criticism of Islam in Europe, is seizing on the Quran burnings and other \u201cIslamophobia<\/span>\u201d\u00a0controversies<\/a>\u00a0to extract concessions from Sweden and other European countries. Abdullah Bozkurt, an exiled Turkish journalist who lives in Sweden, told FWI that Erdo?an is seeking to \u201cexert pressure on Western countries\u201d and \u201cstrengthen his bargaining power\u201d to crack down on his political opponents in Europe and to \u201cundermine their well-founded criticisms of T\u00fcrkiye on massive human rights violations.\u201d<\/p>\n

The Swedish Security Service (S\u00e4kerhetspolisen, S\u00e4po<\/em>)\u00a0warned<\/a>\u00a0that Quran burnings and the subsequent protests in the Muslim world have resulted in a \u201cworsening of the security situation.\u201d S\u00e4po\u2019s deputy head of counter-terrorism, Susanna Treh\u00f6rning,\u00a0told<\/a>\u00a0SVT public television that there are \u201cinfluential people who are now sending out very clear narratives about Sweden and also calls for revenge.\u201d She added that the \u201cthreat from people within the violent\u00a0Islamist<\/span>\u00a0environment\u201d was \u201cvery high.\u201d<\/p>\n

Swedish Prime Minister Ulf Kristersson\u00a0warned<\/a>\u00a0that his country is facing its \u201cmost serious security challenge since World War II.\u201d Swedish Foreign Minister Tobias Billstr\u00f6m, in a letter to the OIC,\u00a0noted<\/a>\u00a0that although the government denounces the Quran burnings, freedom of expression is guaranteed by the constitution. Swedish Justice Minister Gunnar Str\u00f6mmer\u00a0announced<\/a>\u00a0that the government was considering possible changes to the Public Order Act but that there is no \u201cquick fix\u201d to stop the Quran burnings. Meanwhile, Sweden\u2019s Immigration Agency\u00a0said<\/a>\u00a0that it was reviewing Momika\u2019s residency permit, which expires in 2024.<\/p>\n

On July 30, the Danish government issued a\u00a0statement<\/a>\u00a0saying that it was exploring \u201cthe possibility of intervening in special situations where, for instance, other countries, cultures, and religions are being insulted, and where this could have significant negative consequences for Denmark, not least with regard to security.\u201d It added that \u201cthis must of course be done within the framework of the constitutionally protected freedom of expression and in a manner that does not change the fact that freedom of expression in Denmark has very broad scope.\u201d<\/p>\n

A July 6 opinion poll commissioned by SVT television\u00a0found<\/a>\u00a0that 53% of Swedes favored a ban on Quran burnings, while 47% were opposed or unsure. This compares to a similar poll commissioned by TV4 Nyheterna in February which\u00a0showed<\/a>\u00a0that 42% were in favor of such a ban while 67% were opposed or unsure.<\/p>\n

The editorial board of the Swedish newspaper\u00a0Dagens Nyheter<\/em>\u00a0warned<\/a>\u00a0that Islamists \u201cwill not be content with a blasphemy law because they will always want to go one step further.\u201d The editorial board of the Swedish newspaper\u00a0Expressen<\/em>\u00a0agreed<\/a>\u00a0that the Islamists pressuring Sweden are \u201cunlikely to be content\u201d with a ban on Quran burnings. \u201cThe risk is obvious that small Swedish concessions in this situation would only lead to new demands for submission.\u201d<\/p>\n

Sofie L\u00f6wenmark, a Swedish journalist who covers Islamism,\u00a0said<\/a>\u00a0that calls for a ban on Quran burnings are a smokescreen to hide the larger objective: a ban on legitimate criticism of Islam.<\/p>\n
